1. Introduction

Welcome to CyberSymbio ("we," "our," or "us"). These Terms and Conditions govern your use of our Cyber Essentials certification preparation services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms and Conditions.

2. Definitions

In these Terms and Conditions:

• "Client," "you," or "your" refers to the individual or entity purchasing our Services.
• "Services" refers to our Cyber Essentials certification preparation services.
• "Application" refers to the Cyber Essentials certification application we help prepare.
• "Certification Body" refers to the IASME-accredited organization that assesses and issues Cyber Essentials certificates.
• "48-Hour Preparation Guarantee" means we will deliver a submission-ready application draft within 48 business hours of receiving all required information.

3. Service Description

Our Services include:

• Consultation to understand your organization's IT infrastructure and security controls
• Preparation of your Cyber Essentials certification application
• Review and refinement of your application based on your feedback
• Guidance on submission to a Certification Body
• Liaison with the Certification Body during the assessment process

We offer two service levels:

1. Express Preparation Service: 48-hour preparation guarantee with priority processing
2. Standard Service: 5-business day preparation timeline

4. Eligibility and Requirements

To use our Services, you must:

• Be at least 18 years old
• Have the authority to enter into binding contracts on behalf of your organization
• Provide accurate and complete information about your organization's IT infrastructure
• Cooperate with our information gathering process
• Have the necessary technical access to implement any recommended security controls

5. Fees and Payment

Our fees are as follows:

• Express Preparation Service: £997 (one-time)
• Standard Service: £697 (one-time)

Payment terms:

• Full payment is required before we begin preparation work
• We accept payment via credit card, debit card, or bank transfer
• All prices are in British Pounds (GBP) and include VAT where applicable
• Additional certification body fees are not included in our pricing

6. 48-Hour Preparation Guarantee

Our Express Preparation Service includes a 48-hour preparation guarantee subject to the following conditions:

• The 48-hour period begins when we receive all required information from you
• "Business hours" means 9:00 AM to 5:00 PM UK time, Monday to Friday, excluding UK bank holidays
• If we fail to deliver a submission-ready application draft within 48 business hours, you are entitled to a full refund of the preparation fee
• This guarantee covers preparation timeliness only, not certification outcomes
• Delays caused by client unresponsiveness or incomplete information void this guarantee

7. Refund Policy

We offer refunds under the following circumstances:

• If we fail to meet our 48-hour preparation guarantee for Express Service
• If you cancel before we have begun substantial work on your application
• If we determine we cannot adequately serve your needs during our initial consultation

Refunds are not available:

• After we have delivered a submission-ready application draft
• If your application is not approved by the Certification Body
• If you change your mind after we have begun substantial work
• For certification body fees, which are paid directly to the certification body

8. Client Responsibilities

As our client, you agree to:

• Provide accurate, complete, and timely information about your organization
• Respond to our queries and requests for information promptly
• Review application drafts in a timely manner
• Implement any necessary security controls identified during the preparation process
• Pay certification body fees directly to the certification body
• Maintain the security controls implemented for certification

9. Intellectual Property

All intellectual property rights in our preparation methodologies, templates, and processes remain our property. Upon full payment, we grant you a license to use the prepared application materials for the purpose of obtaining Cyber Essentials certification.

10. Confidentiality

We treat all client information as confidential and will not disclose it to third parties except:

• As necessary to provide our Services
• As required by law
• With your explicit consent

11. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. By using our Services, you consent to such processing.

12. Limitations of Liability

To the fullest extent permitted by law:

• Our total liability to you for any claim related to our Services shall not exceed the fee paid for those Services
• We are not liable for any indirect, special, or consequential damages
• We are not liable for certification decisions made by the Certification Body
• We are not liable for security incidents that occur after certification

13. Service Limitations

You acknowledge that:

• We are a preparation service, not a certification body
• Certification outcomes are determined solely by the Certification Body
• Our Services do not guarantee certification approval
• Our Services do not include implementation of security controls
• Our Services do not include ongoing compliance monitoring

14. Termination

We may terminate our Services if:

• You breach these Terms and Conditions
• You provide false or misleading information
• You fail to cooperate with our information gathering process
• We determine we cannot effectively serve your needs

You may terminate our Services at any time, but refund eligibility depends on the work completed as outlined in our Refund Policy.

15. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes via email or through our website. Continued use of our Services after changes constitutes acceptance of the updated terms.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
